's palace. we'll have a live report from cairo. but, first, u.s. military plans about possible action against syria are changing. senior pentagon officials tell cnn the syrian government could be escalating the civil war. there are new concerns the assad regime is preparing to use chemical weapons. let's get to our pentagon correspondent barbara starr. barbara, how does this change the u.s. military's syria plan? are we talking u.s. troops, boots on the ground? >> well, not at this point, clearly, deb. but what we do know is that u.s. officials tell us that they are updating some of the military options for action against syria's chemical weapons capability, why are they doing this? of course, we chatted about this in the last several days. officials say they do have the intelligence now that syria has filled aerial bombs with deadly sarin gas. haven't moved it to airplanes yet, but this is very concerning because that, of course, would be the next step. so once you have the deadly bombs, the u.s. has to look at what the options could be, what they might want to target to essentially

the u.s. economy is continuing to heal and continuing to heal from the wounds inflicted by the worst downturn since the great depression. this is obviously similar to what we heard in past months. but the president or -- certainly the white house pointing to this as proof that his economic policies should continue. specifically in this reaction. they point to that bush era tax cut for middle class americans that's set to expire along with tax cuts for all americans. here at the end of the year saying that that needs to get pushed through. we are not seeing really the frenzy, obviously. we got so used to that frenzy of reaction coming out ahead of the election. and it certain sly in the a frenzy we haven't heard -- heard from the rnc. they say similar to what they always say. while a downtick in the unemployment tick is unwelcomed news, unemployment remains painfully high, conversely to what president obama or what the white house saying pointing to his policies as not working for the economy. we haven't heard from the speaker's office i don't believe yet but he will be talking before

lawsuit. apple won the first round in august, when a u=s district court judge ruled that samsung would pay apple over a billion dollars in damages. that's not enough for apple our tech reporter gabe slate is here. case? >> 1.0 $5 billion was the verdict earlier this year. apparently that was not enough that hearing is still going on and the san jose and the judge said that she is likely to reduce that $ 1.05 billion.. fine... with her belief that the jurors could have underestimated the danger is implicated. the details of the verdict in the month of august. nothing has happened yet samsung has not paid one penny to apple. they have appealed this decision in hopes of a mistrial. the judge will have to decide if it is a mistrial or not. most likely it will not be and to go forward. however, it could be appealed. we will have to wait and see. otherwise, they are going to wait and see weather or not ... one thing i would like to mention is how consumers could be impacted. if samsung products could be prices are released. that is not unlikely but possible. let me show you video these samsung v
